These Terms & Conditions (“Terms”) govern your access to and use of the websites, online stores, and related services operated by Adept Supply LLC dba Pregame Time Gummies (“Pregame Time,” “we,” “us,” or “our”). By accessing or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

2) Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases or create an account.
Keep your account credentials confidential. You are responsible for all activity under your account.
We may refuse service, close accounts, or cancel orders at our discretion where permitted by law.

3) Product information & availability

We aim to describe products accurately; minor variations in color/packaging may occur.
We may limit quantities, discontinue products, or change specifications without notice.
No medical claims: Products are not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional before use if you have a medical condition, are pregnant/nursing, or take medications.

4) Pricing, taxes & promotions

Prices are in U.S. dollars unless stated otherwise and may change without notice.
Applicable taxes, shipping, and fees are calculated at checkout.
Coupons, promotions, and bundles are subject to their own terms and may be modified or ended at any time.

5) Orders & payment

By placing an order, you authorize us and our payment processor(s) (e.g., Stripe) to charge the payment method provided for the total amount.
Orders are offers to purchase; we may accept or decline any order (e.g., for suspected fraud or inventory issues).
If a pricing or availability error occurs, we may cancel the order and issue a refund.

6) Shipping, risk of loss & delivery

Shipping options and costs are shown at checkout. Estimated delivery dates are not guaranteed.
Risk of loss passes to you upon our delivery of the order to the carrier. Please inspect packages upon arrival.
For missing/damaged items, contact us within 7 days of delivery with your order number and photos if applicable.

7) Returns & refunds

For safety reasons, refunds are available for unopened packages only. Return shipping is paid by the buyer unless required by law. Shipping charges are non-refundable except where the return is due to our error.

8) Subscriptions & recurring billing (if offered)

If you enroll in a subscription, your plan will auto-renew at the stated interval until canceled.
You may cancel any time before the next renewal through your account or by contacting support. Cancellations take effect for future charges only.

9) User content, reviews & feedback

By submitting reviews, photos, testimonials, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for marketing and operational purposes.
You represent that you own or control the rights to the content you submit and that it is accurate and lawful.
We may remove content that violates these Terms or applicable law.

10) Acceptable use

You agree not to:

Use the Services for unlawful purposes or to violate others’ rights.
Interfere with or disrupt the Services, networks, or security features.
Attempt to reverse engineer, scrape at scale, or harvest data without permission.
Post or transmit harmful, deceptive, or infringing content.

11) Intellectual property

The Services, including text, graphics, logos, and designs, are owned by or licensed to Pregame Time and are protected by intellectual property laws.
You may not use our marks (including “Pregame Time” and related logos) without prior written permission.

12) Third-party services & links

We may link to or integrate third-party services (e.g., payment processors, analytics, social platforms). We are not responsible for their content, policies, or practices. Review their terms and privacy policies.

13) SMS/Text messaging terms

By opting in, you consent to receive SMS/MMS from Adept Supply LLC dba Pregame Time Gummies. Message frequency varies. Message & data rates may apply.
Reply STOP to opt out and HELP for assistance. Consent is not a condition of purchase.
We may use third-party messaging providers and maintain opt-in/opt-out records to comply with TCPA and A2P 10DLC requirements.

14) Disclaimers

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” without warranties of any kind, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation.

15) Limitation of liability

To the fullest extent permitted by law, in no event will Pregame Time or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services or purchase of products. Our aggregate liability for direct damages shall not exceed the amount you paid for the product(s) giving rise to the claim in the 12 months preceding the event.

16) Indemnification

You agree to defend, indemnify, and hold harmless Pregame Time and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or misuse of the Services.

17) Governing law; disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.
Informal resolution: Before filing a claim, you agree to try to resolve the dispute by contacting us at [email protected].
Disputes may be brought in the state or federal courts located in Minnesota, and you consent to their jurisdiction and venue.

18) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information.

19) Changes to the Services or Terms

We may update the Services and these Terms from time to time. The “Effective date” above reflects the latest version. Continued use after changes means you accept the updated Terms.

20) Termination

We may suspend or terminate your access to the Services at any time, with or without cause, subject to applicable law. Upon termination, provisions that by their nature should survive will remain in effect (e.g., intellectual property, disclaimers, limitations of liability, governing law).
